Blog4 America: A Democracy or a Republic?By Burnie Thompson6-24-2011Recently I debated a political science professor about the difference between a democracy and a republic. He wrote a blog (Outside the Beltway) about it being a distinction without a difference, promoted by conservative commentators. Calling America a republic and not a democracy is almost nonsense, concludes Troy Universitys Steven L. Taylor. The professor and I agreed that pure democracy and republics both fall under the big umbrella of democracy, or rule by the people. We agreed that a republic is distinguished by mass participation and representatives governing for the people. We also agreed that the Constitution limits government power.But the Founders did not use the word democracy in our two foundational documents, the Declaration of Independence and the Constitution. We also pledge allegiance to the Republic. Indeed, the Constitution guarantees to every State in this Union a Republican Form of Government. Our Republic jealously guards individual rights because our Founders worried about mob rule. The Constitution is replete with anti-democratic mechanisms, such as the electoral college and the original appointment of U.S. senators by state legislatures. Benjamin Franklin famously told a woman after the Constitutional Convention that they had created a Republic, if you can keep it. James Madison warned against the whim of man, and helped provide the rule of law within a Constitutional republic. Edwin Randolph warned against the turbulence and folly of democracy. John Adams pointed out that democracy never lasts long. It soon wastes, exhausts, and murders itself. There was never a democracy yet that did not commit suicide." The professor agreed that the Founders were wary of pure democracy, in which two wolves and a sheep vote on whats for dinner (as the old joke goes). But he says that a pure democracy does not exist anywhere. He equated our Constitutional democracy with others around the world. Our disagreement came down to the nature of rights. Our Constitution is the oldest and shortest charter of liberty in the world. It does not grant us a single right; it protects the rights endowed to us by our Creator. Other constitutional democracies claim to grant rights as dispensations of government rather than being inherent in our humanity.Our Founders took the theological premise that we are all equal in Gods eyes, and created the political application of a Constitutional Republic. In other words, no man has the right to rule over another without his consent because we are born free and dignified human beings. God made us that way; not government. That is a distinction with a difference, and one worth remembering. # # # #
Blog3 Capitalism is the Pursuit of HappinessBy Burnie Thompson7-2-2011While attending a recent radio conference, a speaker gushed over the small country of Bhutan: It doesnt measure Gross Domestic Product; it measures Gross Domestic Happiness. How awesome is that? The audience nodded and smiled. I didnt.You can take Bhutans happiness meter and tickle yourself with it, but at some point you better measure the economy. In fact, I argue that capitalism is likely to produce lots of happiness. Lets consider a couple of definitions. Economics is commonly understood as the study of how scarce resources are allocated. A textbook definition of capitalism is a system with minimal government interference in private economic transactions.But heres a better definition of capitalism: It is your pursuit of happiness in a free society. Capitalism provides the climate to achieve something and to be proud of it. And each persons honest dealings serve everyone elses needs and desires. Nobody is coerced, and everybody acts voluntarily for mutual benefit. A professor once asked me to define the American Dream. After thinking it over, I suggested that the American Dream is all about ownership. Not simply wealth or material possessions, but ownership of your life. John Locke argued that Every man has a property in his own person. In other words, you have a right to live a self-directed life. You have ownership of your choices.The Declaration of Independence lists the pursuit of happiness as a God-given right. Unlike many other countries where your future is planned for you, America is the land of opportunity. But it is not the land of guarantees. You are free to choose, as Milton Friedman said, but you are also free to lose. Success and failure are necessary outcomes in capitalism. Pursuing happiness is fraught with risk. Like pain, failure is a signal that we are doing something wrong and impels us to change course. Pain and failure actually protect us. Capitalism is thwarted when government reduces risk by subsidizing failure with taxpayer bailouts. Some ideas and companies need to fail so they can be corrected or abolished, not subsidized. Herbert Spencer was right when he said Shielding men from the effects of folly is to fill the world with fools. The surest way to be unhappy is to avoid risk altogether and expect perfection. Capitalism is the only economic system that protects our property and respects our choices. In other words, it allows us to pursue our own happiness. The speaker at the radio conference didnt understand that measuring GDP is actually one way to measure happiness. # # # #
Blog2 The Government Plays Let’s PretendBy Burnie Thompson5-20-2011Our government is playing a giant game of Let’s Pretend with us. House Speaker John Boehner pretended to cut $38.5 billion in spending to avoid a government shutdown. In reality, it was only $352 million – less than 1 percent of what we were told. President Barack Obama pretends to want to reduce the federal deficit of $1.6 trillion, even as he proposes more and more “investments” to “win the future.” He pretends reckless spending of money we don’t have is an investment.Just five years ago, our federal deficit was about $160 billion dollars; now it’s 10 times higher. It’s hard for us to grasp the magnitude of a trillion dollars. Imagine if Jesus spent a million dollars per day every day until now. He’d have to continue for another 698 years to reach a trillion dollars. Our federal government says it needs $3.8 trillion to operate this year, but it will only collect $2.2 trillion in taxes. That’s a stunning shortfall, yet the politicians promise more spending. Our state government also plays Let’s Pretend. Florida’s Speaker of the House Dean Cannon called the legislative session “a smashing success.” The Republicans held super majorities in the legislature but could not pass meaningful pension reform (401K style), paycheck protection from union dues, or lawsuit reform. Taxpayers are still on the hook with Citizens Property Insurance. They couldn’t even repeal the intrusive septic tank inspections. If this legislature were the 1967 Green Bay Packers, Coach Vince Lombardi would be livid. Winning half your games is not a smashing success. We expected a Super Bowl victory. The problem is that our government is perverted. Instead of protecting each of our God-given rights equally, it has turned into a contemptible apparatus whereby some people try to live at the expense of everybody else. Politicians plunder some Americans for the benefit of others for political gain. Elected officials who do this violate their oath to support and defend the Constitution. And they perpetuate a system that is fiscally not sustainable. That’s the reality.I enjoy playing Let’s Pretend with my little girls, but not with my government at any level. It’s time to get serious about putting government back in its proper place. How about a few government reforms? Let’s start with the “Not another cent” proposal. No U.S. legislator should be paid another penny until they balance the budget without any tax hikes. As long as they spend other people’s money with impunity, they will not have any incentive to live in fiscal reality.

What they really mean is to limit our choices and to subjugate us to their will. Part of their strategy is to confuse us by presenting bills that are misnamed and that contain thousands of pages of lawyer-speak. This is why we need to reform the so-called reformers. We should pass a law that requires all bills to be shorter than the U.S. Constitution, which is only 37 pages long in my pocket edition. Compare that to the ObamaCare law, which has about 2,700 pages of incomprehensible jargon.Take, for instance, a random section (3201:C:II) of the Patient Protection and Affordable Care Act written by attorneys masquerading as representatives and senators: the applicable percentage increase that would apply to a qualifying plan in the area under subsection (o) as if any reference in such subsection to 2012 were deemed a reference to 2010 and as if the determination of a qualifying county under paragraph (3) (B) of subsection were made for 2010.Now you see why Will Rogers said that lawyers write so endless others in his craft can make a living out of trying to figure out what he said. Is it any wonder Washington has been overrun by legalese when we vote so many attorneys to represent us? Forcing Congress to keep bills succinct will help restore the rule of law, which allows people to understand the rules under which they have to live. It will also make it more difficult for lawmakers to attach additional provisions to bills known as riders. Alexander Hamilton explained why its important to for laws to be limited. It will be of little avail to the people that laws are made by men of their own choice if the laws be so voluminous that they cannot be read, or so incoherent that they cannot be understood; if they be repealed before they are promulgated, or undergo such incessant changes that no man who knows what the law is today can guess what it will be tomorrow. We should demand that our lawmakers dispense with doublespeak and obfuscation. Who will write and sponsor legislation that requires bills to be short and simple? Then we could actually review proposals online 72 hours in advance as so many politicians keep promising. Ask your representative to sponsor the No Longer Than the Constitution Act. The ancient Chinese proverb had it right: The beginning of wisdom is calling things by their right name. Its also the beginning of good government. # # # #
